Some of Idaho’s Congressional Delegation Responds to Biden’s Supreme Court Reform Proposals

President Joe Biden is pushing for several reforms to the U.S. Supreme Court.

Biden posted the proposed reforms on the White House website. The proposals include reforms to immunity provisions, term limits, and a binding code of conduct.

Here are three paragraphs from the press release about each reform:

No Immunity for Crimes a Former President Committed in Office: President Biden shares the Founders’ belief that the President’s power is limited—not absolute—and must ultimately reside with the people. He is calling for a constitutional amendment that makes clear no President is above the law or immune from prosecution for crimes committed while in office. This No One Is Above the Law Amendment will state that the Constitution does not confer any immunity from federal criminal indictment, trial, conviction, or sentencing by virtue of previously serving as President.”

Term Limits for Supreme Court Justices: Congress approved term limits for the Presidency over 75 years ago, and President Biden believes they should do the same for the Supreme Court. The United States is the only major constitutional democracy that gives lifetime seats to its high court Justices. Term limits would help ensure that the Court’s membership changes with some regularity; make timing for Court nominations more predictable and less arbitrary; and reduce the chance that any single Presidency imposes undue influence for generations to come. President Biden supports a system in which the President would appoint a Justice every two years to spend eighteen years in active service on the Supreme Court.”

Binding Code of Conduct for the Supreme Court: President Biden believes that Congress should pass binding, enforceable conduct and ethics rules that require Justices to disclose gifts, refrain from public political activity, and recuse themselves from cases in which they or their spouses have financial or other conflicts of interest. Supreme Court Justices should not be exempt from the enforceable code of conduct that applies to every other federal judge.”

Idaho Dispatch contacted Idaho’s congressional delegation for a response to Biden’s proposal.

Senator Mike Crapo’s (R) office provided the following quote from the Senator as his official response:

“The Supreme Court plays a vital role in safeguarding the U. S. Constitution. Political changes could give way to more partisan infiltration for many generations to come, and would present greater and unnecessary volatile challenges in fairly and constitutionally settling the most pressing judicial cases affecting Americans.

I oppose President Biden’s efforts to inject politics into the process of the Court. Constitutional principles are the foundation for all Supreme Court decisions, even those that are controversial.”

Congressman Russ Fulcher (R) posted the following response on X:

“President Biden and Vice President Harris’ proposal to institute term limits for Supreme Court justices is blatantly unlawful.

Article III of the U.S. Constitution grants that federal judges have life tenure unless otherwise removed by impeachment.

This is a dangerous proposition that would threaten the Court’s independence and further politicize our judicial system.”

Congressman Mike Simpson did not return our request for comment and did not post any response online directly to Biden’s proposals.

While Simpson did not respond to Biden’s proposals, he did post a response to Vice President Kamala Harris’s suggestion that she was open to adding more members to the U.S. Supreme Court.

Simpson posted on X yesterday,

“Harris has openly campaigned to pack the Supreme Court to push through her socialist agenda.

I’ll fight to protect the legitimacy of the Court.”

Senator Jim Risch (R) has not posted on social media or responded to our request for comment.

Idaho Dispatch also contacted Idaho Democratic Party Chairwoman Lauren Necochea for comment on the proposals, but we have not received a response yet.

  1. Anyone with half a brain knows this is still Obama running things. So tired of seeing a man that can’t finish a sentence or find his way off stage, being credited for policies bent on destroying America. Please. Give Americans some credit. We aren’t that stupid. What we would like to know is why there are zero investigations on Obama, when we all know who is behind all the unaccountable systemic treason, sedition and subversion. .

      1. This is just another openly blatant move to dilute the Constitution and further upset the balance of the 3 separate powers of the different branches of our government. LEAVE our Constitution alone, and by the way, START ADHERING TO IT! ALL branches and bureaucrats alike!

  2. Talks about immunity on a president, what about on the house and senate, must have needed a nap.
    Same thing for the lifetime membership to the house and senate country club.
    I thought we already had laws about conduct.
    Ever noticed anything the Democrats point fingers at they are almost always the ones guilty of it.

  3. Let’s do this instead: If any Supreme Court Justice doesn’t follow the Constitution Verbatim, they shall be immediate removed from the court.

  4. President Biden’s proposal is nothing more that a further attempt to delegitimization the Supreme Court and further politicize government agencies. There is a reason for our three branches of government. It is called checks and balances. Biden wants a court that will blow with the political winds, the Marxist socialist winds. He wants to destroy our constitution and our country.Harris wants the same thing only perhaps more radical. We must not let them succeed. Protect the US Constitution.

  6. This is just political theatre designed to create controversy against a majority of constitutionalist justices that are impeding the progressive/woke agenda. The idea is to promote electing a progressive president in order to put new progressive justices on the court if the opportunity arises. (Think Jackson). The Supreme Court is the only thing stopping them. They want justices who will not define what a woman is.

    I trust Simpson’s words as much as I do the press secretary. Fortunately for Idaho, there’s the new IDGOP. But we must remove the RINO cowards that have made themselves enormously wealthy off the backs of the good people of Idaho.
