ACLU Sues Idaho Over Law that Limits Benefits to Illegals

The ACLU of Idaho has filed a federal lawsuit challenging a new state law that limits access to certain public benefits for individuals living in the country unlawfully.

What’s Happening: The law, set to take effect July 1, requires proof of lawful U.S. residency to receive services such as HIV medication, prenatal care, and some food assistance programs.

The lawsuit was filed on behalf of Dr. Abby Davids and four HIV-positive patients who are not legal permanent residents. According to the complaint, the law is vague, conflicts with federal regulations, and puts both individual and public health at risk.

Digging Deeper: Supporters of the law, passed earlier this year by the Idaho Legislature and signed by Governor Brad Little, say it ensures taxpayer-funded services go only to legal residents. Critics argue it could deny life-saving care to vulnerable populations and burden healthcare providers with unclear verification requirements.

“This law forces doctors to choose between following state policy and protecting their patients’ lives,” the ACLU said in a statement. The plaintiffs are seeking class-action status to extend protections to others affected by the law.
