2023 Legislative Wrap Up – The List of House Bills That Are Now Idaho Law

The 2023 Idaho Legislative Session is coming to an end. We have compiled a list of bills that have passed as of April 4 at 8:30pm MT. While several contentious bills sit on Governor Brad Little’s desk awaiting a signature, veto, or no-signature passage, here are the bills that originated in the House of Representatives that have become law so far.

The short description of each came from the Idaho Legislature’s website.

Most new laws in Idaho become effective on July 1 of the year they were passed.

House Bill 1: ELECTIONS – Amends existing law to provide requirements for postelection audits ordered by the Secretary of State.

House Bill 3: PHYSICIANS AND PHYSICIAN ASSISTANTS – Amends existing law to revise definitions and to remove requirements regarding supervisory registration.

House Bill 4: UNIFORM CONTROLLED SUBSTANCES – Amends existing law to revise provisions regarding controlled substances.

House Bill 5: PUBLIC ASSISTANCE – Repeals existing law relating to the Food Stamp Revolving Fund, which is no longer in use.

House Bill 7: TRANSPORTATION – Amends existing law to disqualify a driver convicted of human trafficking from holding a commercial driver’s license for a specified period.

House Bill 8: TRANSPORTATION – Amends existing law to provide for temporary vehicle permits pursuant to board rule.

House Bill 9: TRANSPORTATION – Amends existing law to provide for the electronic renewal of commercial driver’s licenses and to provide for the sharing of residency information between the Idaho State Tax Commission and the Idaho Transportation Department.

House Bill 10: TRANSPORTATION – Repeals existing law relating to an obsolete provision regarding the American Trucking Association Settlement Fund.

House Bill 11: ELECTIONS – Amends existing law to revise a provision regarding the use of private moneys for the purpose of election administration.

House Bill 13: HUMAN RESOURCES DIVISION – Amends existing law to remove obsolete language and to clarify language regarding certain personnel practices.

House Bill 15: HUMAN RESOURCES – Amends existing law to provide for correct references to the Division of Human Resources, to allow for pay increases, and to remove a provision regarding hearings before the division.

House Bill 16: DIVISION OF HUMAN RESOURCES – Amends existing law to provide for the hiring of employees under approved apprenticeship programs.

House Bill 17: STATE PERSONNEL SYSTEM – Amends existing law to revise the definition of “overtime work.”

House Bill 18: WORKER’S COMPENSATION – Amends existing law to remove a sunset clause from a provision that makes psychological injuries suffered by first responders compensable.

House Bill 21: TAXATION – Amends existing law to revise the definition of “Internal Revenue Code.”

House Bill 22: SALES AND USE TAX – Adds to existing law to provide for the withholding of sales and use tax from city and county governments in certain instances.

House Bill 23: OCCUPATIONAL AND PROFESSIONAL LICENSES – Amends existing law to replace references to the Division of Building Safety with the Division of Occupational and Professional Licenses.

House Bill 24: WORKFORCE DEVELOPMENT – Amends and adds to existing law to establish the Idaho Launch Grant Program and to revise provisions regarding the In-Demand Careers Fund.

House Bill 31: NURSES – Amends existing law to revise provisions regarding certified medication assistants.

House Bill 50: SALES TAX – Amends existing law to clarify the uses that may be made of certain funds by special purpose taxing districts.

House Bill 51: PROPERTY VALUATION NOTICES – Amends existing law to require that certain information be provided on all property valuation assessment notices.

House Bill 52: GRAND JURIES – Amends existing law to revise a provision regarding who may be present at sessions of a grand jury.

House Bill 56: TRANSPORTATION – Amends existing law to revise the definition of “daylight hours” with respect to certain drivers.

House Bill 57: TRANSPORTATION – Amends existing law to provide for the issuance of special placards together with disabled veteran license plates.

House Bill 59: INCOME TAXES – Amends existing law to revise a provision regarding the income tax credit for capital investment.

House Bill 60: USE TAXES – Amends existing law to revise provisions regarding application of use taxes to articles acquired more than 90 days prior.

House Bill 61: TELEHEALTH ACCESS ACT – Adds to existing law to provide for mental and behavioral health care.

House Bill 66: CRIME – Adds to existing law to provide that reporting child abuse, abandonment, or neglect falsely is a misdemeanor.

House Bill 70: COUNTY INDIGENT SERVICES AND FINANCES – Amends and repeals existing law to revise provisions affected by the repeal of the County Indigent Program and the Catastrophic Health Care Cost Program.

House Bill 73: DRUG COURTS AND MENTAL HEALTH COURTS – Adds to existing law to authorize counseling services to an adult receiving service through a drug or mental health court.

House Bill 74: OCCUPATIONAL LICENSING – Amends and adds to existing law to provide for attorney licensure by the Idaho Supreme Court, to prohibit additional methods of demonstrating competency to qualify for universal licensure, to provide for conditional licensure under certain conditions, and to provide for universal work recognition.

House Bill 80: INCOME TAX – Amends existing law to revise provisions regarding evidence of a taxpayer’s expenditures.

House Bill 83: HEALTH – Amends existing law to revise eligibility requirements for the Conrad J-1 Visa Waiver Program and the National Interest Waiver Program.

House Bill 85: COUNTIES – Amends existing law to provide for the same county services administrative fee for all title transactions.

House Bill 87: TRANSPORTATION – Amends existing law to limit funding regarding the Transportation Expansion and Congestion Mitigation Fund to the expansion of travel lanes and congestion mitigation.

House Bill 89: CITY COUNCILS – Amends existing law to revise provisions regarding the filling of a vacancy on a council and to provide for the filling of a vacancy in certain instances.

House Bill 90: LEGAL NOTICES – Amends existing law to revise provisions regarding electronic publication of legal notices.

House Bill 92: EDUCATION – Adds to existing law to require financial literacy courses in certain grades.

House Bill 93: MOTOR VEHICLE REGISTRATION – Amends existing law to revise provisions regarding motor vehicles eligible for biennial registration.

House Bill 94: NOXIOUS WEEDS – Amends existing law to revise provisions regarding county duties associated with certain notices.

House Bill 95: COMMERCIAL FEED – Amends existing law to clarify that animal remedies for certain animals that include ingredients from industrial hemp are not considered adulterated.

House Bill 96: ENERGY RESOURCES – Amends existing law to provide for the promotion and development of clean energy resources for declared purposes, to revise provisions regarding powers of the Idaho Energy Resources Authority, and to provide for clean energy generation projects.

House Bill 97: STATE CONTROLLER – Amends and adds to existing law to provide that all state officers and agencies shall report agreements entered into to the State Controller.

House Bill 99: SALES TAX – Amends existing law to revise a provision regarding the distribution of sales tax to certain special purpose taxing districts.

House Bill 102: HUMAN RESOURCES – Amends existing law to provide for advancements in pay based on certain factors and to provide for retention bonuses in certain circumstances.

House Bill 103: RECREATION – Adds to existing law to provide for the assumption of risk and legal responsibility by recreational participants for injuries associated with recreational activities in state parks.

House Bill 106: PROHIBITIONS ON UTILITY CONNECTIONS – Adds to existing law to prohibit any type of local government entity from restricting certain types of utility connections.

House Bill 107: MOTOR VEHICLES – Amends existing law to provide for the unique design elements of radio amateur license plates.

House Bill 112: EDUCATION OPPORTUNITY RESOURCE COMMITTEE – Amends existing law to revise committee members, to allow for certain distributions of appropriated moneys, to require certain distributions, and to authorize certain funding increases.

House Bill 116: CONSUMER PROTECTION – Amends existing law to revise provisions regarding automatic subscription renewal cancellation.

House Bill 117: SEXUAL OFFENDER REGISTRATION – Amends existing law to revise a provision regarding release from registration requirements.

House Bill 118: FLOOD DISTRICTS – Amends existing law to revise provisions regarding flood control district commissioners.

House Bill 124: VOTERS – Amends existing law to revise provisions regarding accepted voter identification at the polls.

House Bill 128: DEALERS AND SALESMEN LICENSING – Amends and adds to existing law to revise provisions regarding termination, cancellation, and renewal of franchise agreements and related protests, hearings, and costs.

House Bill 132: TRANSPORTATION – Amends existing law to establish a strategic initiatives grant program.

House Bill 135: PROPERTY TAXES – Amends House Bill 51 to provide an effective date of January 1, 2024.

House Bill 143: FISH AND GAME – Amends existing law to provide for a fur buyer license and to revise provisions regarding taxidermist and fur buyer licenses.

House Bill 144: FISH AND GAME – Amends existing law to provide for trapping license certificates.

House Bill 149: CRIMINAL HISTORY RECORDS – Amends existing law to provide that criminal history records shall be shielded from disclosure under certain circumstances.

House Bill 153: OCCUPATIONAL LICENSING – Adds to existing law to provide for limited licenses for medical school graduates who are not accepted into a residency program.

House Bill 156: PREDATORY WILDLIFE – Amends existing law to classify rattlesnakes as predatory wildlife.

House Bill 162: HEALTH – Amends, repeals, and adds to existing law to revise terminology and other provisions regarding virtual health care.

House Bill 163: PARENTAL RIGHTS – Amends existing law to provide for certain disclosures and school policies.

House Bill 172: INCOME TAXES – Amends Laws of 2022 to change the effective date for the new income tax rates to January 1, 2023.

House Bill 179: VOTING – Adds to existing law to prohibit the use of ranked choice voting in Idaho.

House Bill 184: TRANSPORTATION – Amends existing law to define “congestion mitigation.”

House Bill 186: METHODS OF EXECUTION – Amends existing law to provide for execution by firing squad and to provide for certain requirements prior to an execution.

House Bill 187: HEALTH – Repeals and adds to existing law to provide authority to administer CPR or use an automated external defibrillator and to provide legal immunity.

House Bill 191: PUBLIC PROCUREMENT – Amends and adds to existing law to provide that procurement decisions shall not be based on environmental, social, and governance standards.

House Bill 194: APPROPRIATIONS – PUBLIC SCHOOLS – EDUCATIONAL SERVICES FOR THE DEAF AND THE BLIND – Relates to the appropriation to the Public Schools Educational Support Program’s Division of Educational Services for the Deaf and the Blind for fiscal year 2023.

House Bill 202: EDUCATION – Adds to existing law to provide for the display of the national motto in certain circumstances.

House Bill 207: APPROPRIATIONS – DEFICIENCY WARRANTS – Relates to the appropriations to deficiency warrant funds for fiscal year 2023.

House Bill 208: APPROPRIATIONS – PUBLIC SCHOOLS – TEACHERS DIVISION – Relates to the appropriation to the Public Schools Educational Support Program’s Division of Teachers for fiscal year 2023.

House Bill 209: APPROPRIATIONS – HEALTH AND WELFARE – INDIRECT SUPPORT SERVICES – Relates to the appropriation to the Department of Health and Welfare for the Division of Indirect Support Services for fiscal year 2023.

House Bill 235: UNDERGROUND FACILITIES DAMAGE PREVENTION – Amends existing law to revise provisions regarding underground facilities damage prevention.
